Summary: Brazil’s Supreme Court has still not decided whether to open an investigation involving Justice Alexandre de Moraes in connection with allegations arising from the Banco Master/Daniel Vorcaro case. A new material development occurred on September 17: STF President Edson Fachin removed from the September 23 agenda the separate proceeding concerning Justice André Mendonça’s handling of the Banco Master case, saying the pending procedural question has a direct relationship with that proceeding. No new date was set.

What the Supreme Court decided today

On September 17, STF President Edson Fachin removed the proceeding concerning Justice André Mendonça from the plenary agenda previously set for September 23. Fachin said its inclusion will be rescheduled later because points in the pending procedural question directly affect that proceeding.

The underlying Moraes proceeding remains suspended after Justice Flávio Dino requested additional review time on September 15. At that point, the Plenary was still deciding a procedural question about whether the related proceedings involving Moraes and Mendonça should be handled together or separately. The formal partial tally was 4–3 in favor of separate consideration when the review request interrupted the matter. This was a procedural vote, not a vote on whether to investigate Moraes and not an impeachment vote.

The STF has not reached a merits decision on opening an investigation against Moraes. Allegations connected to Banco Master remain allegations under institutional and judicial scrutiny and are not findings of criminal responsibility. Moraes has denied wrongdoing and challenged the legality of the material attributed to the investigation.

What is happening in the Senate

Separate from the Supreme Court proceeding, formal impeachment petitions against Justice Alexandre de Moraes remain registered in the Brazilian Senate. PET 20/2026, PET 28/2026 and PET 29/2026 have been officially listed as in progress and awaiting action. No confirmed Senate presidential decision, admission, dismissal, agenda placement or impeachment vote has been identified in the latest official check.

The existence or filing of a petition does not mean that an impeachment proceeding has been admitted or that the Senate has voted on removal.

What happens next

For the Supreme Court, the next material event is the return of the matter after Justice Dino’s review request, a new procedural ruling, or a newly designated hearing date. The September 23 proceeding concerning Mendonça is no longer a confirmed next hearing date and will be rescheduled later.

For the Senate, the next material event would be a formal action by the Senate presidency on one or more petitions, including admissibility, dismissal, referral, agenda placement or another official procedural step.
